These Terms of Service ("Terms") govern your access to and use of the Motion Fit website, online fitness coaching services, workout plans, and related content (together, the "Services"). By using the Services, requesting a program, or submitting a form, you agree to these Terms. Please read them carefully.

01Acceptance of these Terms

By accessing the Motion Fit website or using any of the Services, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Services.

If you are using the Services on behalf of another person, you represent that you are authorized to accept these Terms for that person, and that they meet the eligibility requirements set out below.

02What Motion Fit provides

Motion Fit is an online fitness coaching service. We offer personalized workout guidance, custom training plans, virtual coaching sessions, home fitness programs, progress tracking, fitness check-ins, food diary review, and general nutrition and wellness habit support.

Our role is to help you choose a realistic training direction, follow a structured plan, stay consistent, and improve your daily fitness habits through qualified online coaching. The specific deliverables for your engagement depend on the service or package you select and are confirmed with you before you begin.

03Health & safety acknowledgment

Motion Fit provides fitness coaching and general wellness support only. The information and services provided are not medical advice, diagnosis, or treatment.

You should consult a physician before starting a new exercise or nutrition routine, especially if you have medical conditions, injuries, are pregnant, or have other health concerns. You participate in any exercise or routine voluntarily and at your own risk.

You agree to tell your coach about any limitations, injuries, pain, or health conditions that may affect your training, and to stop any activity that causes pain or feels unsafe. Results vary depending on consistency, lifestyle, starting point, and individual circumstances, and we do not guarantee any specific outcome.

04Eligibility & accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. If you are under 18, you may only use the Services with the involvement and consent of a parent or legal guardian.

When you submit information through our forms, you agree to provide accurate, current, and complete details and to keep them up to date. You are responsible for the information you share with us and for maintaining the confidentiality of any access credentials provided to you.

05Requesting services & coaching

When you submit a service or plan request, you are asking the Motion Fit team to contact you to discuss your goals. Submitting a request does not create a binding contract on its own and does not automatically charge you.

After you submit a request, the Motion Fit team will contact you by phone or email to confirm your goals, answer questions, and agree on the scope, schedule, and pricing of your coaching before any service begins.

Communication

By submitting a form, you agree that we may contact you using the details and preferred method you provide, for the purpose of responding to your request and delivering the Services.

06Pricing & payment

Prices shown on the website are presented in US dollars and are indicative of typical service and package costs. The exact price applicable to your engagement is confirmed with you before you start.

  • Monthly coaching and support services are billed on a recurring basis for the period you select.
  • One-time plans and packages are billed as a single charge for the deliverable described.
  • Session-based services are billed per session or per agreed bundle.

Nothing is charged automatically simply by submitting a request. Payment terms, billing cycles, and accepted payment methods are confirmed during onboarding.

07Cancellations & changes

You may request to pause, adjust, or cancel a recurring coaching service in line with the terms confirmed at onboarding. We ask for reasonable notice so your coach can wind down your plan appropriately.

For scheduled virtual sessions, we ask that you provide advance notice if you need to reschedule. We reserve the right to reschedule sessions where necessary and will work with you to find a suitable alternative.

08Client responsibilities

To get the most from coaching and to train safely, you agree to:

  • Follow your plan within your own comfort and ability, and rest when needed.
  • Use appropriate technique and a safe training environment and equipment.
  • Share honest, accurate information about your progress, schedule, and any health changes.
  • Use the Services and any provided materials for your own personal, non-commercial use.

You agree not to misuse the Services, interfere with their operation, or attempt to access areas or data you are not authorized to access.

09Intellectual property

All content on the Motion Fit website and within the Services — including workout plans, written guidance, text, graphics, layout, and branding — is owned by or licensed to Motion Fit and is protected by applicable intellectual property laws.

You are granted a limited, personal, non-transferable license to use the materials provided to you as part of your coaching. You may not reproduce, resell, redistribute, or publicly share these materials without our prior written permission.

10Disclaimers & limitation of liability

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Motion Fit disclaims all warranties, express or implied, including fitness for a particular purpose, and does not warrant that the Services will be uninterrupted, error-free, or will achieve any particular result.

To the fullest extent permitted by law, Motion Fit will not be liable for any indirect, incidental, special, or consequential damages, or for any injury, loss, or damage arising from your participation in exercise or your use of the Services. You acknowledge that you participate voluntarily and assume the inherent risks of physical activity.

11Governing law

These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of law principles. Any dispute relating to these Terms or the Services will be subject to the jurisdiction of the courts located in Kentucky, unless otherwise required by applicable law.

12Changes & contact

We may update these Terms from time to time to reflect changes to our Services or for legal and operational reasons. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
